{"id":831,"date":"2022-03-06T07:30:00","date_gmt":"2022-03-06T13:30:00","guid":{"rendered":"https:\/\/600hemphill.com\/?p=831"},"modified":"2022-03-06T07:54:59","modified_gmt":"2022-03-06T13:54:59","slug":"831","status":"publish","type":"post","link":"https:\/\/600hemphill.com\/index.php\/2022\/03\/06\/831\/","title":{"rendered":"En Banc Review?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>This is a cross-p<\/em>o<em>st from <a href=\"http:\/\/www.600commerce.com\">600Commerce<\/a>, it involves a Dallas Court of Appeals decision but is of broader statewide interest &#8211;<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Fifth Court&#8217;s recent <a href=\"https:\/\/600commerce.com\/wp-content\/uploads\/2022\/02\/panda-power-ercot-opinion.pdf\">ERCOT opinion<\/a>&nbsp;found that matter appropriate for <em>en banc<\/em> review when, between its original panel opinion and the present proceedings, the Texas Supreme Court had ruled on immunity issues in a way that undermined a key assumption of the panel opinion about ERCOT&#8217;s immunity. (&#8220;In the most recent of these three opinions, the supreme court stated: &#8216;Though we have contemplated it, we have yet to extend sovereign immunity to a purely private entity\u2014one neither created nor chartered by the government\u2014even when that entity performs some governmental functions.'&#8221;).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At least nominally, that analysis puts the case in the &#8220;just right&#8221; category of my&nbsp;<a href=\"https:\/\/600commerce.com\/wp-content\/uploads\/2018\/07\/5_Goldilocks-and-the-Three-Outcomes.pdf\">Goldilocks<\/a> article about intermediate-court <em>en banc<\/em> review, although the importance of the subject matter may make it a &#8220;big splash&#8221; case as well.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The&nbsp;<a href=\"https:\/\/600commerce.com\/wp-content\/uploads\/2022\/02\/schenck-ercot-dissent.pdf\"><em>ERCOT<\/em> dissent<\/a> suggests another, fragrance-based approach to decisions about <em>en banc<\/em> review: \u201cTo be clearly erroneous, a decision must strike us as more than just maybe or probably wrong, it must . . . strike us as wrong with the force of a five-week old, unrefrigerated dead fish.\u201d&nbsp; (citing <a href=\"https:\/\/scholar.google.com\/scholar_case?case=15982102970732002387&amp;q=parts+and+elec+motors+inc&amp;hl=en&amp;as_sdt=3,44\">Parts &amp; Elec. Motors, Inc. v.
