This week on the “Coale Mind” podcast, I had top-flight jury consultant Jason Bloom<\/a> as a special guest; in the episode <\/a>we touch on the many pervasive effects that 2020 will have on jurors and jury selection, including:<\/p>\n\n\n\n

– A surprising eagerness<\/strong> of people to show up and serve on juries, in part driven by widespread feelings of frustration<\/strong> after months of shutdown;<\/p>\n\n\n\n

– Concern about what Jason calls the \u201cmassive exercise in confirmation bias<\/strong>\u201d that potential jurors bring to the courthouse with them, depending on how restricted a juror\u2019s information sources may be;<\/p>\n\n\n\n

– The once-obscure psychological terms \u201cultracrepidarian<\/strong>\u201d and \u201cpareidolia\u201d (you have to listen to the podcast to explore those terms\u2019 meaning \ud83d\ude42;<\/p>\n\n\n\n

– Remembering that 2020 changed potential jurors<\/strong> not only because of COVID, but because of Black Lives Matter, the Biden-Trump election and its aftermath, etc.<\/p>\n\n\n\n

– And a reminder that jury service\u2014unlike the similar civic-engagement exercise of voting\u2014forces jurors to form a consensus<\/strong> among their different beliefs; and<\/p>\n\n\n\n
